Those in attendance were not allowed in the executive session with the town trustees, Kremmling police force, the town attorney, insurance representative and other legal counsel. The Town is expected to respond early in November and is expected to appeal. Robert Mark Smith who was awarded over $700,000 in the excessive force lawsuit earlier this month is expected to return to Grand County District Court next week to face a Class 5 felony menacing charge for an alleged altercation with one of his tenants in July of 2016.
